Official Sweepstakes Rules

 

NO PURCHASE NECESSARY TO ENTER OR TO WIN. YOU HAVE NOT WON YET! SWEEPSTAKES IS ONLY OPEN TO LEGAL RESIDENTS OF THE UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE SIXTEEN (16) AND OVER AT THE TIME OF THE ENTRY.  TURKEY HILL IS LOCATED IN PENNSYLVANIA AND OHIO. ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS APPLY. All employees, officers, directors and agents of Turkey Hill, 2601 River Road, Conestoga, PA 17516 (the “Sponsor”) and COHEN-FRIEDBERG ASSOCIATES, LLC 8429 Lorraine Road, Suite #146, Lakewood Ranch, FL 34202 (www.cfapromo.com) (the “Administrator”) and their respective parents, affiliates, subsidiaries, dealers, franchisees and retailers, (collectively the “Sweepstakes Entities”) and each of their immediate family members (parents, siblings, children and/or spouses), regardless of where they live, or members of the same household (whether related or not) are not eligible to participate in this Sweepstakes.

 

  1. Sweepstakes Period:

The Turkey Hill Gift Card Sweepstakes (the "Sweepstakes") will begin on or about Monday, February 5th, 2024, at 12:01 a.m. Eastern Time (“ET”) and ends at 11:59 p.m. ET on Monday February 19th, 2024 (the “Sweepstakes Period”). The clock maintained by the Sponsor in connection with the operation of the Sweepstakes will be the official timekeeper of this Sweepstakes.

 

  1. How to enter:

TEXT TO ENTER: By texting you authorize the Sponsor to communicate with you via text. There will be several reply text messages to each sent/received text.

Text the eligible Official Keyword TURKEY HILL to 48424, you will receive a reply text message with a link to the Sweepstakes registration entry page (“Entry Site”). Complete all required information on the Entry Site, agree to the Official Rules, and submit. Standard text message and data rates apply to each message sent or received may apply. Other charges may apply; check your mobile plan for rates/details. Participation may not be possible on all carriers. For help, text HELP to 48424. To cease receiving messages regarding the Sweepstakes, send the word STOP to 48424. You will receive a confirmation message. You will not receive future text messages regarding the Sweepstakes except for notification if you are selected as a potential winner. Please note that proof of text message submission does not constitute proof of delivery/receipt.

You may find the keyword to enter on Turkey Hill Farms point of sale, email and paid social media. By entering, you may receive Sponsor emails and or texts containing Sponsor marketing information. You may opt-out any time after you receive your first email or text.

Alternate Means Of Entry: To enter by mail without texting, hand print in ink your name, complete address, telephone number and age on a postcard and mail to: Turkey Hill Gift Card Swag Sweepstakes entry, 8429 Lorraine Road, Suite #146, Lakewood Ranch, FL 34202. Mail-in entries must be postmarked by 2/12/24 to be received no later than 2/27/24. No photocopies, facsimiles or mechanical reproductions will be accepted. Sponsor is not responsible for lost, late, mutilated, misdirected, illegible, incomplete, inaccurate, stolen, or postage due entries or mail.

LIMIT: No matter which form of entry you select, one (1) entry per person per day ET regardless of the method of entry.  For purposes of these Official Rules a “day” is defined as any twenty-four (24) hour period during the Sweepstakes Period beginning at 12:01 a.m. ET and ending at 11:59 p.m. ET.

 

  1. Drawing date: A random drawing will be conducted on or about Thursday, February 29th, 2024 to award two (2) prizes. Each prize will be One (1) Turkey Hill $250 (Two Hundred & Fifty Dollar, U.S.) Gift Card (each a “Prize”) from all eligible entries received in accordance with the deadlines set forth herein. The random drawings will be conducted by the Administrator whose decisions are final and legally binding on all aspects of this Sweepstakes. The potential prize winners may be notified by telephone and/or mail and/or e-mail, using contact information associated with the potential winner’s entry or provided or collected at the time of entry. Entrants are solely responsible for ensuring that the information provided when entering is accurate. Sweepstakes Entities shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within seventy-two (72) hours of the first notification attempt, such potential winner will forfeit his or her Prize and an alternate winner may be selected. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the Prize for any reason prior to award, such potential prize winner will be disqualified, and an alternate prize winner may be selected.

 

  1. Prize Details: Only the number of Prizes listed below will be awarded in this Sweepstakes.

 

Two (2) Prizes:

Each Winner will receive one (1) $250 Turkey Hill Gift Card. Approximate retail value of each Prize $250.

 

Limit: One (1) Prize per person or household.

 

  1. Misc. Prize Notes: Odds of winning depend on the total number of eligible entries received. The Winners will receive their prize by mail within approximately three (3) weeks of the winner confirmation.

 

  1. General Prize Conditions: No cash alternative or prize substitutions will be allowed, except Sponsor reserves the right to substitute Prize(s) of comparable value if a Prize listed is unavailable for any reason. Prize winners shall be solely responsible for all federal, state and/or local taxes (if any), and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize.

 

  1. Publicity: Except where prohibited by law, acceptance of a Prize constitutes prize winner’s permission for Sponsor and its designees to use winner’s name, picture/portrait, likeness and/or voice, for advertising and promotional purposes without consideration or further permission in any media now known or hereafter devised for advertising and publicity purposes throughout the world, in perpetuity, without additional compensation.

 

  1. General Conditions:

(a)  By entering this Sweepstakes, all Entrants release the Sweepstakes Entities, Turkey Hill Co., and their respective parent, subsidiary and affiliated entities including, all of their respective shareholders, officers, directors, employees, agents, contractors, attorneys, successors and assigns (the “Released Parties”) from and against all claims and damages arising out of or in connection with each Entrant's participation and/or entry in the Sweepstakes and/or his/her receipt or use or misuse  of the Prize awarded in the Sweepstakes.         

  • Released Parties are not responsible for problems downloading or uploading any Sweepstakes-related information to or from the web site or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic mail entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the web site, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Entrant’s ability to participate in the Sweepstakes.
  • None of the Released Parties shall be held responsible for, and Entrant hereby releases the Released Parties from any claims arising from or in any way relating to: (i) late, lost, delayed, illegible, damaged, corrupted or incomplete entries, incorrect or inaccurate capture of, damage to, or loss of entries or entry information or technical failures of any kind, including but not limited to (x) unauthorized human intervention in any part of the entry process or the Sweepstakes; (y) use of any Prize and (z) the random drawing selection process including the outcome of the Sweepstakes.

 

  1. Release: By entering entrants agree to hold harmless and indemnify the Sweepstakes Entities, and their respective brokers, stockholders, governors, and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation in the Sweepstakes; or (ii) the receipt or use of the prizes awarded in the Sweepstakes. Entrants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any Prizes awarded, other than the administration of the Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively in the Commonwealth of Massachusetts, (ii) any and all claims, judgments and awards shall be limited to actual Prize in dispute but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses of the prize in dispute, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida.

 

  1. Participant’s Personal Information: Personally identifiable information submitted by entrants as part of this Sweepstakes will be treated in accordance with Turkey Hill’s Privacy Policy @ https://www.turkeyhill.com/help/privacy-policy. The personal information collected in this Sweepstakes may be shared with the Sweepstakes Entities and other related parties participating in this Sweepstakes for purposes of Sweepstakes administration only.
